POA stands for Power of Attorney and DPOA stands for Durable Power of Attorney. What's the difference you may ask. Well there is a significant difference. In many states you can appoint a power of attorney over health care, finances or both. If the Power of Attorney is durable it simply means that if you become mentally incompetent the agent or appointed power of attorney would still have the authority to act on your behalf. Which by the way a power of attorney can only act on your behalf if you are incapacitated or if you request they do so. So a standard power of attorney would serv you no purpose if your intent is to have someone make decisions on your behalf should you become incapacitated to do so. So Be sure the power of attorney is durable and must state in the body that you give them the power to make such decisions should you become incapacitated or mentally incompetent. The Power of Attorney becomes null at death or whenever you decide to declare it invalid in writing or appoint a new agent on your behalf.
